In this grievance arbitration appeal, this Court granted limited review to consider whether a pending grievance filed in opposition to an Act 111 employees termination is rendered moot where the employee fails to attempt to grieve a separate and subsequent set of charges which also seek his termination. The proper resolution of this appeal, however, requires consideration of an important predicate question: the level of deference due to the arbitrators decision on mootness. For the reasons that follow, we hold that, in light of our narrow certiorari scope of review, the arbitrators decision on mootness is not subject to judicial review. Accordingly, we affirm the decision below, albeit on different grounds than relied upon by the Commonwealth Court.
